Terms & Conditions of Use

These Terms & Conditions of Use ("Site Terms") govern access to and use of the HOHY Club (Helping Others Help Yourself Club) website ("Site").

By accessing, browsing, or using the Site, you agree to comply with these Site Terms and applicable laws. If you do not agree with these Site Terms, you should not use the Site.

1. Related Policies and Terms

These Site Terms apply to your access to and use of the HOHY Club website.

Your membership in HOHY Club and participation in specific HOHY Club programs may also be governed by other applicable agreements, policies, and program rules, including the:

Membership Agreement

Code of Ethics

Anti-Spam Policy

referral commission and re-entry rules

Award Program Rules

Benefit Program Rules

Community and Voting Program Rules

Testimonial Program Rules

Other applicable HOHY Club rules and policies

If a specific HOHY Club program has additional rules, those rules apply to participation in that program.

2. Modification of Site Terms

HOHY Club may modify these Site Terms from time to time.

Updated Site Terms will be posted on the Site with the applicable effective or updated date. Unless otherwise stated, changes become effective when posted.

Your continued use of the Site after the effective date of revised Site Terms constitutes acceptance of those revised terms.

3. United States Usage

The Site is operated from the United States and is subject to applicable United States federal and California state laws.

Users accessing the Site from other locations are responsible for complying with laws applicable to them.

4. License and Site Access

HOHY Club grants users a limited, non-exclusive, non-transferable, and revocable right to access and use the Site for personal or authorized organizational purposes in accordance with these Site Terms.

Except as expressly authorized by HOHY Club or permitted by applicable law, users may not:

(a) Resell or commercially exploit the Site or Site Materials;

(b) Modify, adapt, reverse engineer, decompile, or disassemble Site software or materials;

(d) Use HOHY Club information, member information, program information, or Site Materials for unauthorized commercial purposes;

(e) Use data-mining tools, bots, spiders, scrapers, automated software, or similar technologies to collect information from the Site or its users; or

(f) Attempt to bypass, interfere with, manipulate, or defeat the security, access controls, tracking mechanisms, or proper operation of the Site.

"Site Materials" include text, graphics, photographs, drawings, logos, designs, software, code, databases, page layouts, program materials, and other content made available through the Site.

HOHY Club may restrict or revoke access when a user violates these Site Terms or other applicable HOHY Club rules, subject to applicable law.

5. Changes, Misprints, and Errors

HOHY Club makes reasonable efforts to maintain accurate and current information on the Site. However, errors, omissions, delays, or inaccuracies may occur.

HOHY Club may correct errors, update information, or modify Site Materials when appropriate.

Where a specific HOHY Club program is governed by published program rules, those applicable rules will control the administration of that program.

6. Passwords and Account Security

Members are responsible for maintaining the confidentiality of their account credentials and for taking reasonable steps to prevent unauthorized access to their accounts.

Members must not knowingly allow another person to use their account or password except where expressly authorized by HOHY Club.

Members should promptly notify HOHY Club if they believe that:

Their password or account credentials have been compromised;

Unauthorized access to their account has occurred; or

Suspicious or unauthorized activity appears in their account.

HOHY Club may take reasonable measures to protect a Member's account and the Site, including requiring password changes, additional identity verification, temporary account restrictions, or other appropriate security measures.

Members are responsible for activity performed through their accounts to the extent permitted by applicable law. HOHY Club is not responsible for losses resulting from a Member's failure to reasonably protect account credentials, except to the extent responsibility cannot lawfully be excluded.

7. Electronic Communications

By creating or maintaining a HOHY Club account, Members agree that HOHY Club may provide communications electronically when permitted by applicable law.

HOHY Club may send communications necessary to administer membership, accounts, transactions, referral commissions, awards, benefits, programs, security, and other Club services.

Members may also choose to receive newsletters or promotional communications. Members may opt out of promotional communications through available unsubscribe methods.

Opting out of promotional communications does not prevent HOHY Club from sending communications reasonably necessary to administer a Member's account, transactions, membership, or participation in HOHY Club programs.

8. Intellectual Property

The Site and Site Materials may contain trademarks, service marks, trade names, logos, copyrighted materials, software, designs, photographs, graphics, and other intellectual property owned by HOHY Club or third parties.

HOHY Club's names, logos, designs, website content, and other proprietary materials may not be copied, imitated, reproduced, distributed, modified, or used without authorization except as permitted by these Site Terms or applicable law.

Third-party trademarks, names, logos, and other intellectual property appearing on the Site remain the property of their respective owners.

Users may view and, where appropriate, print reasonable portions of Site Materials for personal or authorized organizational, informational, and non-commercial purposes.

Nothing in these Site Terms transfers ownership of HOHY Club intellectual property to any user.

9. Software

Software made available through the Site is provided for authorized use in connection with HOHY Club services.

Except as permitted by applicable law or expressly authorized by HOHY Club, users may not copy, distribute, sell, modify, reverse engineer, decompile, disassemble, interfere with, or create derivative works from HOHY Club software.

10. Hyperlinks and Third-Party Websites

Users may link to the HOHY Club home page in a manner that does not falsely imply sponsorship, endorsement, affiliation, or approval by HOHY Club and does not present HOHY Club in a false, misleading, deceptive, or defamatory manner.

Users may not frame the Site or use HOHY Club trademarks, logos, or proprietary materials in a manner that creates a false impression of affiliation or authorization.

The Site may contain links to third-party websites, social media platforms, multimedia content, or other external resources.

HOHY Club does not control third-party websites or services and is not responsible for their availability, content, security, privacy practices, accuracy, or operation.

Users should review the terms and privacy policies applicable to third-party websites and services.

11. Member Submissions and Content

Members may be permitted to submit information or materials through the Site, including testimonials, drawings, comments, assistance requests, program applications, voting selections, links, photographs, and other content ("Member Content").

Members retain ownership of their original Member Content except where otherwise provided by applicable law or agreed to by the Member.

By submitting Member Content, the Member grants HOHY Club the rights reasonably necessary to receive, store, process, review, display, administer, and use that content for the purpose for which it was submitted and as otherwise authorized under the applicable HOHY Club program rules.

Certain programs may provide additional content-use permissions. For example, Testimonial submissions are subject to the applicable Testimonial Program rules concerning promotional use, publication, translation, and distribution.

Members are responsible for ensuring that they own or have appropriate permission to submit or link to Member Content and that their submissions do not violate the copyright, trademark, privacy, publicity, or other rights of another person or organization.

Members must not submit content that:

Is false, fraudulent, deceptive, defamatory, threatening, harassing, discriminatory, obscene, or otherwise unlawful;

Contains adult or sexually explicit material prohibited by HOHY Club rules;

Promotes illegal activities;

Contains unauthorized advertising, spam, or promotional solicitations;

Infringes intellectual property, privacy, or other legal rights;

Contains malicious software, viruses, harmful code, or other material intended to interfere with computer systems;

Impersonates another person or falsely represents an affiliation; or

Otherwise violates applicable HOHY Club rules or policies.

Approved fundraising, charitable, scholarship, Special Case FM Assistance, and other activities expressly authorized under HOHY Club programs are not prohibited solicitations under this section.

12. Policies and Enforcement

HOHY Club may review and investigate suspected violations of these Site Terms, the Membership Agreement, applicable program rules, or other HOHY Club policies.

HOHY Club may take reasonable action when necessary to protect Members, the Site, HOHY Club programs, or other persons. Such action may include:

Issuing warnings;

Removing or restricting content;

Restricting access to certain Site features or programs;

Temporarily suspending an account;

Terminating Site access or membership when permitted under applicable HOHY Club rules; or

Referring suspected unlawful activity to appropriate authorities when necessary.

HOHY Club may preserve, review, or disclose account information and Member Content when reasonably necessary to administer the Site, investigate suspected violations, protect the rights or safety of HOHY Club or others, or comply with applicable legal requirements.

Personal information will be handled in accordance with the HOHY Club Privacy Policy and applicable law.

13. Applicable Law and Venue

These Site Terms shall be governed by the laws of the State of California, without regard to its conflict-of-law principles.

Subject to applicable law, any legal action arising out of or relating to these Site Terms shall be brought in the appropriate state or federal courts located in Los Angeles County, California.

Users are responsible for ensuring that their use of the Site complies with laws applicable to them.

14. Termination of Site Access

HOHY Club may restrict, suspend, or terminate a user's access to the Site when the user violates these Site Terms, applicable HOHY Club policies or program rules, engages in fraudulent or unlawful activity, threatens Site security, or otherwise misuses the Site.

Termination of Site access does not automatically determine the disposition of referral commissions, awards, benefits, or other Member interests. Those matters will be handled in accordance with the Membership Agreement, referral commission and re-entry rules, applicable program rules, and applicable law.

Provisions that by their nature should continue after termination will remain effective.

15. Electronic Records

HOHY Club may provide agreements, notices, disclosures, program information, transaction information, and other records electronically where permitted by applicable law.

Members are responsible for maintaining a valid email address and other contact information necessary to receive account-related communications.

Electronic records maintained by HOHY Club may be retained as part of HOHY Club's ordinary business records in accordance with applicable law and the HOHY Club Privacy Policy.

16. Severability

If any provision of these Site Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

17. Waiver

HOHY Club's failure to enforce any provision of these Site Terms does not constitute a waiver of that provision or HOHY Club's right to enforce it in the future.

18. Disclaimer

To the fullest extent permitted by applicable law, the Site and Site Materials are provided on an "as available" basis.

HOHY Club makes reasonable efforts to maintain the availability, accuracy, and security of the Site but does not guarantee that the Site will always be uninterrupted, error-free, completely secure, or free from harmful components.

Information concerning specific HOHY Club memberships, referral commissions, Awards, Benefits, Community Programs, Voting Programs, and other programs is subject to the applicable published rules and eligibility requirements.

Nothing on the Site should be interpreted as a guarantee that a Member will earn referral commissions, receive an award or benefit, achieve a particular ranking, or obtain any specific financial result.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, HOHY Club and its owners, officers, directors, employees, agents, and representatives shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, or inability to use, the Site, including loss of profits, data, use, or other intangible losses, except where such limitation is prohibited by applicable law.

To the fullest extent permitted by applicable law, HOHY Club's total cumulative liability arising from or relating to a Member's use of the Site shall not exceed the total membership fees actually paid by that Member to HOHY Club.

Nothing in these Site Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.
