Membership Agreement
As a member of the HOHY Club (Helping Others Help Yourself Club), you ("You" or "Member") are required to read and agree to the terms and conditions outlined in this Agreement. If you do not agree to these terms, you should not register for or participate in the HOHY Club.
The HOHY Club reserves the right to modify these terms at any time at its sole discretion by updating this document. Any revisions become effective upon posting on the HOHY Club website unless a different effective date is specified. Continued participation after the effective date constitutes acceptance of the revised terms.
A. HOHY Club GOAL
HOHY Club is designed to help individuals, families, businesses, schools, and nonprofit organizations improve their financial well-being while supporting one another through membership, referral, Award, Benefit, Community, and other Club programs.
HOHY Club is committed to administering its programs fairly and responsibly while respecting Member privacy. Personal information is handled in accordance with the HOHY Club Privacy Policy.
B. BASIC REQUIREMENTS FOR HOHY Club
MEMBERSHIP
1. MINIMUM AGE
To participate, you must be at least 14 years old.
2. PROVIDE ACCURATE INFORMATION
You are required to provide HOHY Club with accurate contact and residential information and promptly update this information if it changes or if HOHY Club requests additional information for legitimate tax-related purposes or any other legal reason. HOHY Club has the right to verify the information you provide, and you agree to comply with such verification. You must not impersonate another person or misrepresent your identity. HOHY Club may terminate any account and associated membership that contains false or misleading information. HOHY Club is not responsible for lost payments or communications resulting from your failure to provide accurate contact information as required.
3. ENROLLMENT
There is no charge to become a Priority Member (PM). Once a PM has earned $30, they will automatically be upgraded to a Gold Member (GM), and HOHY Club will deduct a $30 membership fee from their account. The GM membership fee is a one-time payment of $30. There is no upfront membership fee to enroll as a Fundraiser Member (FM-). Once an FM- has earned $30 in referral commissions, HOHY Club will deduct the applicable $30 membership fee and upgrade the FM- to Fundraiser Member (FM) status. HOHY Club may, at its sole discretion and for any reason, refuse to accept membership applications to the fullest extent permitted by applicable law.
4. HOHY Club NEWSLETTER AND OTHER EMAILS
Members may subscribe to HOHY Club newsletters and receive promotional emails. Members may opt out of promotional emails at any time through their Account Information or other available unsubscribe methods. Communications necessary to administer a membership, account, transaction, or HOHY Club program may still be sent when permitted by applicable law.
5. TERMINATION AND CANCELLATION
HOHY Club may suspend or terminate a membership for violations of this Agreement, fraudulent conduct, unlawful activity, abuse of Club programs, or other legitimate business reasons, subject to applicable law.
6. MEMBER ETIQUETTE
Members must not tamper with, hack, spoof, copy, modify, disrupt, or otherwise interfere with HOHY Club's website, systems, security, administration, or proper functioning. Members must not use automated software, bots, scripts, or similar technologies to manipulate HOHY Club accounts, referrals, Achievement Points, voting, awards, benefits, or other Club programs.
Violations may result in disciplinary action, including restriction of program participation, suspension, or termination of membership, depending on the nature and severity of the violation and subject to applicable law. Any effect on accrued or unpaid referral commissions will be determined in accordance with this Agreement, the applicable referral commission and re-entry rules, program rules, and applicable law.
C. YOUR RELATIONSHIP TO HOHY Club
By completing the membership registration, you are applying to receive services from HOHY Club and establishing a membership relationship. Your use of the service does not create an employee-employer relationship.
D. REFERRAL REWARD
Eligible members may earn referral commissions for qualified referrals of Gold Members (GMs) and Fundraiser Members (FMs), subject to the HOHY Club referral commission and re-entry rules and applicable program rules.
E. NO SPAM
Members must not use spam, unsolicited bulk communications, deceptive advertising, unauthorized promotional messages, or other prohibited marketing practices to promote HOHY Club or obtain referrals.
Members must comply with the HOHY Club Anti-Spam Policy and applicable laws and regulations. The HOHY Club Anti-Spam Policy is incorporated into this Agreement by reference.
F. MARKETING CLAIMS
You agree not to make any false or misleading statements to your referrals or potential referrals regarding the compensation typically received by HOHY Club Members or the compensation that potential members can expect to receive. Members must not make any guarantee of earnings or represent that participation will result in specific financial outcomes.
G. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, HOHY Club and its owners, officers, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to this Agreement or the use of HOHY Club services, including loss of profits, data, use, or other intangible losses, except where such limitation is prohibited by applicable law.
To the fullest extent permitted by applicable law, HOHY Club's total cumulative liability to any Member arising from or related to this Agreement shall not exceed the total membership fees actually paid by that Member to HOHY Club.
H. GOVERNING LAW AND OTHER TERMS
This Agreement shall be governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to applicable law, any legal action arising out of or relating to this Agreement shall be brought in the appropriate state or federal courts located in Los Angeles County, California.
By participating in HOHY Club and receiving compensation, you agree to comply with applicable California and U.S. laws. If the laws of your country, state, or province limit or prohibit your participation in HOHY Club, you are responsible for ensuring that your participation complies with the laws applicable to you.
This Agreement is personal to you, and you may not transfer, delegate, or assign this Agreement, your referral network, your HOHY Club account, or any other benefits you receive as a HOHY Club Member to another person. Any attempted transfer or assignment is void unless expressly authorized by HOHY Club. HOHY Club may assign this Agreement as permitted by applicable law.
I. SECURITY
HOHY Club uses reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction.
However, no method of transmitting information over the Internet or electronically storing information can be guaranteed to be completely secure. Therefore, while HOHY Club takes reasonable measures to protect Member information, HOHY Club cannot guarantee absolute security.
J. GENERAL
This Agreement, together with the HOHY Club policies and program rules incorporated by reference, constitutes the agreement between the Member and HOHY Club regarding the Member's participation in HOHY Club.
If any provision of this Agreement is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
The failure of HOHY Club to enforce any provision of this Agreement does not constitute a waiver of that provision or of HOHY Club's right to enforce it in the future.
